The Court observed that the Centre had reintroduced provisions earlier struck down by the judiciary, with only \u201cminor tweaks,\u201d amounting to a legislative override of binding judicial precedents.<\/p>\n<p>A bench comprising Chief Justice of India B.R. Gavai and Justice K. Vinod Chandran held that the contested provisions violated the basic principles of separation of powers and judicial independence.<\/p>\n<p>\u201cWe have compared the provisions of the Ordinance and the 2021 Act, and it shows that all provisions struck down, with minor tweaking, have been re-enacted again,\u201d the CJI observed while pronouncing the verdict. \u201cThus, we have held that the provisions of the 2021 Act cannot be sustained\u2026 It amounts to legislative overriding without curing any defects. It falls foul. Thus, it is struck down as unconstitutional.\u201d<\/p>\n<p>The Court also underlined that clearing the judiciary\u2019s mounting pendency is a shared responsibility and \u201cnot the sole obligation of the courts.\u201d<\/p>\n<h3><strong>Earlier Directions Restored<\/strong><\/h3>\n<p>The bench restored previous judicial guidelines regarding tenure and retirement age.
